Draft rules – not yet verified
For homeowners association, condominium association. Version 2026.0-draft.
See CommonWise Work Start a pilotDRAFT – these rules were drafted from official statute text and each quote was matched to that text, but no lawyer has verified them yet. Confirm with your governing documents and counsel.
Unless the meeting is on a schedule already given to owners, notice of each board meeting must go to board members and owners at least 14 days ahead.
“The notice must be given at least 14 days before the meeting and must state the time, date, place, and agenda of the meeting.”
For an unforeseeable event where regular notice is impracticable, the notice period is at least seven days. Notice goes electronically to owners whose electronic address or phone number is known.
“notice of a meeting to address an event or condition that could not have been reasonably foreseen and for which it is impracticable to provide notice as otherwise required by this chapter must be given at least seven days before the meeting”
Notice of annual and special owner meetings must go out at least 14 days, and no more than 50 days, before the meeting.
“An association must provide notice to unit owners of the time, date, and place of each annual and special unit owners meeting not less than 14 days and not more than 50 days before the meeting date.”
Reserve studies must be updated at least every three years by a reserve study professional, based on a visual site inspection.
“An updated reserve study must be prepared at least every third year by a reserve study professional and based upon a visual site inspection conducted by the reserve study professional.”
For a vote by ballot without a meeting, the ballot deadline must be at least 14 days after the notice date. For votes at a meeting, the general 14-day meeting notice applies.
“The time and date by which a ballot must be delivered to the association to be counted, which may not be fewer than 14 days after the date of the notice”
Board member elections must be conducted by secret ballot regardless of the governing documents.
“Notwithstanding any other law or provision of the governing documents, the following votes of unit owners shall be conducted by secret ballot: (i) Election of board members;”
Electronic ballots are permitted. An owner consents by delivering a record of consent or by casting an electronic ballot, and the association must keep a record of electronic votes.
“A unit owner consents to electronic voting by delivering to the association a record indicating such consent or by casting an electronic ballot.”
The statutory lien exists from the time an assessment is due, so no notice period applies before it arises. Separate delinquency and preforeclosure notices are required before a foreclosure action, not before the lien.
“Recording of the declaration constitutes record notice and perfection of the statutory lien created under this section. Further notice or recordation of any claim of lien for assessment under this section is not required, but is not prohibited.”
Electronic notice is effective only for owners and board members who have consented in a record. The consent must designate the address or system to be used, and it can be revoked.
“Notice to unit owners or board members by electronic transmission is effective only upon unit owners and board members who have consented, in the form of a record, to receive electronically transmitted notices under this chapter”
