DRAFT – these rules were drafted from official statute text and each quote was matched to that text, but no lawyer has verified them yet. Confirm with your governing documents and counsel.

Emergency meetings

No fixed number of days applies to emergency or special board meetings. Notice must be reasonable and simultaneous with notice to the directors. The section number comes from cross-references in the text, since the section heading is not reproduced.

“Notice, reasonable under the circumstances, of special or emergency meetings shall be given contemporaneously with the notice provided to members of the association's board of directors or any subcommittee or other committee of the board of directors conducting the meeting.”

Notice of members' meeting (days before)

Members must get notice at least 14 days before annual or regular meetings and at least 7 days before any other meeting.

“The bylaws shall specify an officer or his agent who shall, at least 14 days in advance of any annual or regularly scheduled meeting and at least seven days in advance of any other meeting, send to each member notice of the time, place, and purposes of such meeting.”

Respond to records inspection request (days)

The text sets the written-notice period a member must give before examining records: 5 business days if professionally managed, 10 if self-managed. It does not state a separate deadline for the association to respond, so this is the closest answer.

“upon five business days' written notice for an association managed by a common interest community manager and 10 business days' written notice for a self-managed association”

Electronic voting allowed

Members may vote electronically at association meetings unless the governing documents expressly prohibit it, and only if the board has adopted guidelines for electronic voting.

“Such voting may take place by electronic means, provided that the board of directors has adopted guidelines for such voting by electronic means.”

Consent needed for electronic delivery of notices

For members' meeting notices, email delivery requires the member to have elected it, and undeliverable email must be followed by U.S. mail. The separate general electronic-means provision (section number not shown in the provided text) excludes notices about enforcement actions, assessment liens, and foreclosure.

“sent to the member by electronic mail, provided that the member has elected to receive such notice by electronic mail and, in the event that such electronic mail is returned as undeliverable, notice is subsequently sent by United States mail”

Notice before recording a lien (days)

Written notice must be sent by certified mail at least 10 days before the association files a memorandum of lien. The section number comes from cross-references in the text.

“The notice shall be sent at least 10 days before the actual filing date of the memorandum of lien.”

Notice of hearing before a fine (days before)

The member must receive notice of the hearing at least 14 days before it, before any charge is assessed. Charges are capped at $50 per single offense or $10 per day for a continuing offense. The section number comes from cross-references in the text.

“shall be hand delivered or mailed by registered or certified mail, return receipt requested, to the member at the address of record with the association at least 14 days prior to the hearing.”

General information, not legal advice. Your governing documents may set longer periods. Calculate your deadlines.
