DRAFT – these rules were drafted from official statute text and each quote was matched to that text, but no lawyer has verified them yet. Confirm with your governing documents and counsel.

Notice of open Board meeting (days before)

Board meeting notice must be posted at least 48 hours ahead. The statute states this in hours, not days.

“that notice of every meeting of the board of managers shall be posted in entranceways, elevators, or other conspicuous places in the condominium at least 48 hours prior to the meeting of the board of managers”

Notice of members' meeting (days before)

Notice of a members' meeting must go out at least 10 days and at most 30 days before the meeting.

“that written notice of any membership meeting shall be mailed or delivered giving members no less than 10 and no more than 30 days notice of the time, place and purpose of such meeting”

Deliver ballots (days before voting deadline)

Ballots go out 10 to 30 days before the election meeting. Candidates get at least 21 days' notice of the ballot-inclusion deadline. The text ties the timing to the election meeting, not a separate voting deadline.

“that the ballots shall be mailed or otherwise distributed to unit owners not less than 10 and not more than 30 days before the election meeting, and the board shall give unit owners not less than 21 days' prior written notice of the deadline for inclusion of a candidate's name on the ballots”

Secret ballot required

Secret-ballot elections are optional. The association may use them once the board adopts rules, so they are not required.

“that the association may, upon adoption of the appropriate rules by the board of managers, conduct elections by secret ballot whereby the voting ballot is marked only with the percentage interest for the unit and the vote itself”

Electronic voting allowed

The Act contemplates electronic voting in board elections. Electronic-voting instructions go to owners 10 to 30 days before the election meeting.

“instructions regarding the use of electronic means for voting shall be distributed to all unit owners not less than 10 and not more than 30 days before the election meeting, and the board shall give unit owners not less than 21 days' prior written notice of the deadline for inclusion of a candidate's name on the ballots”

Annual assessment increase cap without member vote (%)

This is a petition trigger, not a hard cap. Total assessments above 115% of the prior year let owners holding 20% of the votes petition for an owners' meeting within 21 days. The budget is ratified unless a majority of total votes rejects it. Emergency and legally mandated separate assessments are exempt.

“if an adopted budget or any separate assessment adopted by the board would result in the sum of all regular and separate assessments payable in the current fiscal year exceeding 115% of the sum of all regular and separate assessments payable during the preceding fiscal year”

Consent needed for electronic delivery of notices

Electronic delivery of membership-meeting notice requires the owner's consent. It must also be authorized by the condominium instruments or rules, and delivery must be certified in writing.

“except that notice may be sent, to the extent the condominium instruments or rules adopted thereunder expressly so provide, by electronic transmission consented to by the unit owner to whom the notice is given”
