Draft rules – not yet verified
For homeowners association, condominium association. Version 2026.0-draft.
See CommonWise Work Start a pilotDRAFT – these rules were drafted from official statute text and each quote was matched to that text, but no lawyer has verified them yet. Confirm with your governing documents and counsel.
Board meeting notices must be posted at least 48 hours ahead. If not posted, notice must be mailed or delivered at least 7 days ahead. Both are subject to an emergency exception.
“Notices of all board meetings must specifically identify agenda items for the meetings and must be posted in a conspicuous place in the community at least 48 hours in advance of a meeting, except in an emergency.”
The normal posting and mailing notice periods for board meetings do not apply in an emergency. The text gives no separate procedure or minimum notice for emergency meetings.
“In the alternative, if notice is not posted in a conspicuous place in the community, notice of each board meeting must be mailed or delivered to each member at least 7 days before the meeting, except in an emergency.”
This is the website or application posting requirement for member meeting notice and agenda, 14 days before the meeting. The notice provision of s. 720.306 itself is not fully reproduced in the provided text, so this figure comes only from the posting rule.
“Notice of any scheduled meeting of members and the agenda for the meeting, as required by s. 720.306, at least 14 days before such meeting.”
Official records must be made available within 10 business days after a written request from a parcel owner.
“made available to a parcel owner for inspection or photocopying within 45 miles of the community or within the county in which the association is located within 10 business days after receipt by the board or its designee of a written request from the parcel owner.”
A fine or suspension requires at least 14 days' written notice of the right to a hearing. The hearing is held before a committee of at least three members who are not officers, directors or employees.
“A fine or suspension levied by the board of administration may not be imposed unless the board first provides at least 14 days’ written notice of the parcel owner’s right to a hearing to the parcel owner at his or her designated mailing or e-mail address”
Written notice at least 14 days before a board meeting is required when rule amendments regarding parcel use (or special assessments) will be considered.
“Written notice of any meeting at which special assessments will be considered or at which amendments to rules regarding parcel use will be considered must be mailed, delivered, or electronically transmitted to the members and parcel owners and posted conspicuously on the property or broadcast on closed-circuit cable television not less than 14 days before the meeting.”
The association may send notices electronically only to members who have consented in writing to electronic transmission.
“however, a member must consent in writing to receiving notice by electronic transmission.”
