Draft rules – not yet verified
For homeowners association. Version 2026.0-draft.
See CommonWise Work Start a pilotDRAFT – these rules were drafted from official statute text and each quote was matched to that text, but no lawyer has verified them yet. Confirm with your governing documents and counsel.
For board meetings held after declarant control ends, members must get notice and an agenda at least 48 hours ahead. Notice must state the date, time and place.
“notice to members of meetings of the board of directors and meeting agendas shall be given at least forty-eight hours in advance of the meeting by newsletter, conspicuous posting or any other reasonable means as determined by the board of directors.”
After declarant control ends, the board may hold emergency meetings without the 48-hour notice. It may act only on emergency matters, the minutes must state the reason, and the minutes are approved at the next regular meeting.
“An emergency meeting of the board of directors may be called to discuss business or take action that cannot be delayed for the forty-eight hours required for notice.”
Notice of a members' meeting must go out between 10 and 50 days beforehand, by hand delivery or prepaid U.S. mail. It must state the date, time, place and purpose.
“Not fewer than ten or more than fifty days in advance of any meeting of the members the secretary shall cause notice to be hand delivered or sent prepaid by United States mail to the mailing address for each lot, parcel or unit owner”
The association has 10 business days to provide copies of requested records. The text sets this deadline for copies only, not for making records available for examination, which must be 'reasonably available'.
“On request for purchase of copies of records by any member or any person designated by the member in writing as the member's representative, the association shall have ten business days to provide copies of the requested records.”
A regular assessment cannot rise more than 20% over the prior year without majority member approval. A lower limit in the community documents would control instead.
“the association shall not impose a regular assessment that is more than twenty percent greater than the immediately preceding fiscal year's assessment without the approval of the majority of the members of the association.”
General information, not legal advice. Your governing documents may set longer periods. Calculate your deadlines.
